Is mediation the right option for you?

When you are going through a divorce, you always have the option of choosing mediation over litigation. Although some things can only be solved in courts, many couples can come to a successful agreement through mediation alone. Although mediation may be a great option for some, it’s not ideal for everyone, and while there are certainly pros to mediation, there are also cons. The following is a list from our divorce lawyer in Hauppauge of the pros of mediation:

#1. With mediation, the couple is in control.

When you decide to choose litigation over mediation, a judge will be the ultimate deciding factor in the details of your divorce. Mediation, on the other hand, gives the couple a chance to come to an agreement on their own terms.

#2. Mediation can save time and money.

Because of the cooperative nature of mediation, it generally takes much less time than settling the divorce in court. Mediation can also save you in legal fees and other expenses.

#3. Mediation gives you more flexibility.

Since mediation doesn’t require a judge to make the final call on your divorce, it gives you more creativity and flexibility during the settlement. This gives each spouse the option to bring up the issues that are most important so that the settlement can accommodate for the needs of each spouse.

#4. Mediation is generally easier from an emotional standpoint.

Mediators are trained to facilitate understanding and communication, and they can help couples solve their issues amicably. Because of this, mediation is often less emotionally trying than settling a divorce in court.

Now that you know about the pros of mediation, it’s time to learn about the cons. Please stay tuned for our next blog to learn the cons of mediation.
